Is the consultation really free?

Yes, it’s free, takes about 30 minutes, and there’s no obligation. We’ll explain the options that fit your situation, with the pros and cons of each, and you decide what, if anything, to do next.

What happens after I send my details?

You’ll get a text so you can book your free consultation yourself, at a time that suits you. Our team will also follow up by phone and email. You can send your details any time, including evenings and weekends; our office is open Monday–Friday, 8:30 am–4:30 pm.

What is a consumer proposal?

A consumer proposal is a legally binding agreement with your creditors under the Bankruptcy & Insolvency Act, administered by a Licensed Insolvency Trustee, that reduces your unsecured debt. It isn’t uncommon for debts to be reduced by up to 80%, depending on your circumstances. You make one monthly payment (or bi-weekly or weekly), typically over 60 months, and you can pay it off early with no penalty.

Is a consumer proposal right for me?

Not necessarily. It isn’t right for everyone. In general you need to be insolvent: owing more than $1,000 and unable to pay your debts as they come due. We also handle personal bankruptcy and give debt consolidation advice, including pointing you to options we don’t offer ourselves. Your consultation is where we work out the best option for you.

Will I lose my home or car?

In a consumer proposal, you keep your assets, including your home and car. If another option might suit you better, your trustee will explain how it would affect your assets before you decide anything.

Will the collection calls stop?

Once a consumer proposal is filed, creditors must stop most collection calls, legal actions and wage garnishments, effective immediately, and interest stops too.

What does it cost?

There’s no upfront cost. Trustee fees are federally regulated and are included in your monthly payment. For example only: if someone owes $30,000 and their proposal offers creditors $12,000, that works out to $200 a month over five years, with fees included. Every situation is different, and your own numbers will depend on your circumstances.

Which debts can be included?

Credit cards, payday loans, lines of credit, personal loans, student loans and certain CRA debts can be included. Court fines and penalties, child support arrears, property taxes and most secured debts can’t. Your trustee will confirm what applies to you.

Will it affect my credit?

A consumer proposal has less impact on your credit than bankruptcy. Your trustee will explain what to expect in your situation, and two financial counselling sessions are part of the process.
